Mortgage

A mortgage is a security interest in real estate or movable property subject to registration (cars, ships or aircraft).

A mortgage gives the creditor the right to be paid for the value of certain things belonging to the debtor or a third party, with priority over other creditors.

The creation of a mortgage does not mean that the debtor loses the right to ownership and possession of the mortgaged assets.

In order to become effective, even between the parties, the mortgage has to be registered (art. 687 of the Civil Code).
