Donation

A donation is a contract whereby a person, with intention to give gratuitously and at their own expense, disposes of a thing or a right free of charge, or assumes an obligation, for the benefit of the other party (art. 940 of the Civil Code).

With regard to the donation of real property, the contract is only valid if it is executed by public deed or an authenticated private document (art. 947 of the Civil Code).

Pure donations can be made to persons without capacity, regardless of acceptance (art. 951 of the Civil Code).
