Loan

A loan is the contract by virtue of which one party lends the other party money or another fungible thing, whereby the latter is required to return an amount of the same type and quality.

Only those who have the power to dispose of the property are entitled to lend it. In this way, an attorney will require special powers, the representatives of minors require the authorisation of the Public Prosecution Office and representatives of incapable adults require that such powers be granted by the Court.

Without prejudice to that set out in special laws, a loan contract whose amount exceeds EUR 25,000.00 is only valid if executed by public deed.
