Datio in solutum (fulfillment by virtue of donation)

Datio in solutum consists in the performing an obligation in a manner different to what was due, in order to discharge the obligation.

The purpose of the datio pro solvendo is also to perform an obligation in a manner different to what was due, but only seeks to facilitate its discharge.

To discharge the debtor, the creditor is required to intervene.

If this donation consists in the transfer of real property, the act must be executed by public deed or by authenticated private document.
