Process for distribution of common marital property

After the decree of legal separation or a mere judicial separation of property, divorce, declaration as null and void or annulment of marriage, either spouse can file for the distribution of common marital property.

Regarding processes filed as of 1 January 2020, the Notarial Distribution of Property Regime (Law no. 117/2019, of 13 September) and Ordinance no. 278/2013, of 26 August, are applicable.

The notary office chosen by the parties concerned has authority to carry out the processes.
