Process for distribution of decedent’s estate

The purpose of the distribution of the decedent’s estate is to divide the inheritance among the entitled heirs when the parties concerned are unable to reach a consensus.

Regarding processes filed as of 1 January 2020, the Notarial Distribution of Property Regime (Law no. 117/2019, of 13 September) and Ordinance no. 278/2013, of 26 August, are applicable.

The parties concerned can choose the notary office where they wish to initiate their process, as long as there is a relevant connection with the distribution of property, such as, the place where the succession commences, the location of the majority of the properties or the commercial establishment or residence of the majority of the heirs, and as long as the Courts do not have exclusive jurisdiction.
