Purchase agreement

A purchase agreement is the means by virtue of which the ownership of a thing or, another right, is transferred, for a price (art. 874 of the Civil Code).

With regard to the sale of real property, the agreement is only valid if it is executed by means of a public deed or an authenticated private document (art. 875 of the Civil Code).

Purchase agreements between spouses are only possible when they are legally separated (art. 1714/2 of the Civil Code).

The sale of real property by the representatives of a child who is a minor or an incapable adult requires authorisation by the court.

Parents and grandparents cannot sell property to children or grandchildren without the consent of the remaining children or grandchildren and their respective spouses when married under a joint marital property regime (art. 877 of the Civil Code).
