Surface rights

Surface rights consist in the right to build or maintain, perpetually or temporarily, works on another person’s land, or to make or maintain cultivation there (art. 1524 of the Civil Code).

The works and cultivation can either derive from the activity of the holder of the surface rights, subsequent to the constitution of the surface right, or can already exist at the time of the surface right is constituted, but in both cases, ownership of the land belongs to another person.
